The European Commission has just published a database of marketing authorisations for plant health emergencies:
Searches can be made by keywords, country, active substances, authorised use, period of validity. The notifications submitted by the applicant Member State are available as well as the history of old authorisations which are no longer in force.
As a reminder, according to Article 53 of Regulation (EC) No 1107/2009: "in particular circumstances, a Member State may authorise, for a period not exceeding 120 days, the availability in the market of plant protection products for limited and controlled use, where such a measure is necessary because of a danger which cannot be contained by other reasonable means.
The Member State concerned shall immediately inform the other Member States and the Commission of the measure taken, providing detailed information on the situation and the measures taken to ensure consumer safety. »
Where uses of these emergency derogations would result in pesticide residues exceeding the existing MRL, as provided for in Article 18(4) of Regulation (EC) No 396/2005, the marketing authorisations should be immediately notified to the other Member States, the European Commission and EFSA, together with an appropriate risk assessment, with a view to the setting of a provisional MRL for a specified period or the adoption of any other necessary measures concerning those products.
