The implementing decision (EU) 2019/1562 has just been published in the OJEU.
It amends Decisions 2007/305/EC, 2007/306/EC and 2007/307/EC as regards the tolerance period for traces of Ms1xRf1 hybrid oilseed rape, Ms1xRf2 hybrid oilseed rape and Topas 19/2 oilseed rape and products derived therefrom.
In 2007 the European Commission decided to withdraw Ms1xRf1 hybrid rape, Ms1xRf2 hybrid rape and Topas 19/2 rapeseed and products derived from them from the market.
A transitional period of 5 years has been provided for during which products intended for human or animal consumption could contain this type of material (in proportion of 0.9%) without being considered non-compliant.
This deadline has been postponed twice via implementing decisions (EU) 2012/69 and 2016/2268.
It is postponed a 3rd time via the enforcement decision (EU) 2019/1562.
This decision indicates that the presence of these GMOs in food and feed products is tolerated until 31 December 2022 provided that this presence:
- is fortuitous or technically unavoidable; and
- It does not exceed a proportion greater than 0.1% by mass fraction.
