The Decree of 18 April 2019 suspending the introduction, import and placing on the market in France of fresh cherries intended for food production in a Member State of the European Union or a third country in which the use of plant protection products containing the active substance dimethoate is authorised for the treatment of cherry trees has been authorised published on April 20, 2019.
The text concerns the introducers, importers and first marketers on the national territory of fresh cherries intended for food consumption.
France requested on 3 April 2019 that the European Commission take urgent measures to ban the use of dimethoate on cherry trees and suspend the placing on the market. European market for fresh cherries from dimethoate-treated cherry trees, which are likely to pose a serious risk to human health.
Since no action has been taken by the European Commission, France suspends the introduction for a period of one year from the entry into force of this Order, the import and placing on the market in France of fresh cherries intended for food produced in a Member State of the European Union or a third country in which the use of plant protection products containing the active substance dimethoate is authorised for the treatment of cherry trees.
Whereas European rules on organic cherry production do not allow the use of plant protection products containing the active substance dimethoate, cherries from organic production in accordance with Regulation 834/2007 may be introduced, imported or placed on the market.
