The Order of 6 April 2018 suspending the introduction, importation and placing on the market in France of fresh cherries intended for food produced in a Member State of the European Union or a third country in which the use of plant protection products containing the active substance dimethoate is authorised for treatment of cherry trees was published on 10 April 2018.
The text concerns the introducers, importers and first marketers on the national territory of fresh cherries intended for food consumption.
On 29 March 2018 France asked the European Commission to take emergency measures to ban the use of dimethoate on cherry trees and to suspend the placing on the European market of fresh cherries derived from cherry trees treated with dimethoate, which may pose a serious risk to human health.
Since no measure has been taken by the European Commission, France shall suspend for a period of one year from the entry into force of this Order the introduction, importation and placing on the market in France of fresh cherries intended for human consumption produced in a Member State of the European Union or a third country in which the use of plant protection products containing the active substance dimethoate is authorised for the treatment of cherry trees.
Considering that European rules on organic cherry production do not allow the use of plant protection products containing the active substance dimethoate, cherries from organic production in accordance with Regulation 834/2007 may be introduced, imported or placed on the market.
