The Biocidal Products Regulation (EU)
No 528/2012 refers to the placing on the market and use of biocidal products, which are used to protect humans, animals, materials or articles against harmful organisms, such as pests and bacteria, through the action of the active substances contained in the biocidal product. This Regulation aims to improve the functioning of the biocidal products market in the EU, while ensuring a high level of protection of human health and the environment.
Biocidal products are divided into
22 types including:
- disinfectants (human or animal hygiene, surface disinfection, drinking water disinfection, etc.),
- protection products (wood preservatives, building materials, etc.),
- pest control products (rodenticides, insecticides, repellents, etc.),
- other biocidal products (fluids used for embalming, antifouling products)
Under these regulations, the Biocidal Products Committee (BPC), at its February 2014 meeting (BPC-2), established and approved the terms of reference of the Ad Hoc Working Group on Food Residue Transfer Assessment (ARTFood) to continue and finalise guidelines developed by the Working Group on Food Risk Assessment (DRAWG).
Since then, ARTFood has drafted and finalised the proposals:
- Guidance on Estimating Livestock Exposure to Active Substances used in Biocidal Products
- Guidance on Estimating Dietary Risk from Transfer of Biocidal Active Substances into Foods - Non-professional Uses
Both guidance documents are intended for industry and competent authorities.
A third draft guidance document is being prepared and will focus on the Guidance on Estimating Transfer of Biocidal Active Substances into Foods - Professional Uses
The purpose of the guidance document will be to determine whether an evaluation of the MRLs should be carried out for the biocidal product under evaluation. The amount of biocidal residues in food will be estimated and compared to a predefined threshold. If the threshold is exceeded, the authority responsible for setting MRLs shall carry out an evaluation of the MRLs.
