New texts amending EU regulation 2023/915 have just been published in the OJEU.
This regulation clarifies certain points in Annex I:
T2-HT2 :
- Point 1.9.5 concerning bakery products containing at least 90% milled oat products has been replaced by : Bakery products containing at least 75% milled oat products.
The limit of 100 µg/kg applicable from 01/07/24 remains unchanged.
HYDROGEN CYANIDE :
- Point 2.3.2 concerning whole, crushed, ground, broken or crushed unprocessed linseed placed on the market for the final consumer has been replaced by : Whole, crushed, ground, broken or crushed linseed placed on the market for the final consumer.
The 150 mg/kg limit remains unchanged.
- The wording of the exception in point 2.3.1 has been aligned with the wording concerning maximum aflatoxin levels in groundnuts (peanuts) and other oilseeds intended to be crushed for the manufacture of refined vegetable oil.
The limit of 250 mg/kg remains unchanged.
OTA :
- A clarification on the remark in point 1.2.9 concerning oat grains has been added: The maximum content applies to unprocessed cereal grains (surrounded by their husk in the case of oats) placed on the market for initial processing.
The limit of 5 µg/kg remains unchanged.
- Point 1.2.10 concerning products derived from unprocessed cereal grains and unprocessed cereals placed on the market for the final consumer, excluding the products listed in points 1.2.11, 1.2.12, 1.2.13, 1.2.23 and 1.2.24 has been renamed for greater clarity by : Cereals placed on the market for the final consumer, Products derived from unprocessed cereal grains, excluding the products listed in points 1.2.11, 1.2.12, 1.2.13, 1.2.23 and 1.2.24. The term "placed on the market for the final consumer" refers to cereals and not to unprocessed cereal grain derivatives.
The limit of 3 µg/kg remains unchanged.
ZEA :
- Point 1.5.3 concerning cereals placed on the market for the final consumer, flour, meal, bran and germ of cereals as a finished product placed on the market for the final consumer, excluding the products listed in points 1.5.5, 1.5.6 and 1.5.8 has been renamed by : Cereals, bran and germ placed on the market for the final consumer, Cereal flour and semolina, Excluding the products listed in points 1.5.5, 1.5.6 and 1.5.8 In fact the terms "placed on the market for the final consumer" refer to the terms "cereals, bran and germ", and not to the terms "cereal flour and semolina".
The limit of 75 µg/kg remains unchanged.
- A clarification on the remark in point 1.5.1 concerning oat grains has been added: The maximum content applies to unprocessed cereal grains (surrounded by their husk in the case of oats) placed on the market for initial processing.
The limit of 100 µg/kg remains unchanged.
DIOXINS :
- The wording of the comments in points 4.1.1, 4.1.11 and 4.1.12 has been reworded.
The limits remain unchanged.
- In point 4.1.1.8, the term "venison" has been replaced by "cervidae".
The limits remain unchanged.
PAH :
- A distinction between products placed on the market in powder form and products placed on the market in liquid form has been made in points 5.1.13 and 5.1.15 concerning BBF foodstuffs.
The limits remain unchanged.
NOTES :
In note (6) concerning the definition of first-stage processing, hulling has been added as not being part of first-stage processing. In fact, hulling, the operation by which a grain is freed from its husk, is considered to be part of the cleaning process.
NOTES :
- References to Regulation 401/2006 have been deleted. Specific sampling and analysis rules are now established for ergot sclerotia in regulation 2023/2782 and for tropane alkaloids in regulation 2023/2783.
- The wording concerning "unprocessed cereals placed on the market just before undergoing first-stage processing" has been replaced by "unprocessed cereals placed on the market for first-stage processing" in points 1.8.1 (ergot sclerotia), 1.2.9 (OTA), 1.5.1, 1.5.2 (ZEA), 1.6.1 (FUMO), 2.2.2, 2.2.3, 2.2.4 (Tropanic alkaloids).
- In points 1.4.7, 1.4.9, 1.4.10 (DON), 1.9.4, 1.9.9, 1.9.10 (T2-HT2), 1.5.4, 1.5.8 (ZEA), the scope of the exclusion of rice-based products has been clarified as follows: Excluding rice-based products (products whose only cereal ingredients are rice or products processed from rice).
The regulation applies from 16/07/2024.
This regulation amends the dates of application of the maximum limits for ergot alkaloids in certain foodstuffs:
- In point 1.8.2.1 for barley, spelt and oat milling products (with an ash content of less than 900mg/100g of dry matter): the limit of 50 µg/kg remains applicable on 01/07/2024.
- In point 1.8.2.1 b-bis, for wheat milling products (with an ash content of less than 900 mg/100 g of dry matter): the limit of 50 µg/kg will apply from 01/07/2028. Until 30/06/2028 the limit of 100 µg/kg is applicable.
- In point 1.8.2.3, for rye milling products and rye placed on the market for the final consumer: the limit of 250 µg/kg will apply from 01/07/2028. Until 30/06/2028 the limit of 500 µg/kg is applicable.
Foodstuffs legally placed on the market before the above dates may remain on the market until their date of minimum durability or their use-by date.
The regulation applies from 22/07/2024.
